State House Agrees to Senate Amendments for Statewide Smoking Ban Bill

Retail Tobacco Shops, Outdoor Locations Among Exemptions

 

 

February 26, 2010 - The State House of Representatives concurred with the State Senate's amendments for the proposed statewide smoking ban. The House approved the amendments by a vote of 68-54 Thursday, Feb. 25th.

 

     While the legislation will ban smoking throughout the state, the exemptions exempt retail tobacco shops and other business and locations including: 

  • Outdoor areas of any building or facility beyond the access points of the building or facility (10 feet from entrances),
  • Private homes or residences, except when used as a day care
  • 20 percent of Hotel or motel rooms,
  • Gaming floor of a lottery gaming facility or racetrack gaming facility,
  • Class A and Class B clubs holding a license as of January 1, 2009, and who notify the Secretary of Health and Environment in writing within 90 days after the effective date of the bill that they wish to continue to allow smoking on the premises,
  • Private clubs which meet the following criteria:

Are an outdoor recreational facility that is a hunting, fishing, shooting or golf club, business or enterprise operated primarily for the benefit of its owners,members and their guests and is not open to the public,only permit smoking in designated areas where minors are not allowed.

     The approved legislation also will prohibit tobacco self-service displays in retail locations. Important note: the legislation exempts retail tobacco shops that derive 75% of its revenues from the sale of tobacco products. 

     The governor has said he will sign the legislation into law; it will take effect once published as state law.
